{"id":20853,"date":"2020-06-17T00:11:50","date_gmt":"2020-06-16T23:11:50","guid":{"rendered":"http:\/\/www.wheelsforwomen.ie\/?p=20853"},"modified":"2020-06-17T12:33:21","modified_gmt":"2020-06-17T11:33:21","slug":"clamping-how-to-appeal","status":"publish","type":"post","link":"https:\/\/www.wheelsforwomen.ie\/index.php\/clamping-how-to-appeal\/","title":{"rendered":"Clamping: How to appeal"},"content":{"rendered":"\r\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" width=\"850\" height=\"496\" class=\"wp-image-20854\" src=\"http:\/\/www.wheelsforwomen.ie\/wp\/wp-content\/uploads\/2019\/08\/clamping_main.jpg\" alt=\"\" srcset=\"https:\/\/www.wheelsforwomen.ie\/wp\/wp-content\/uploads\/2019\/08\/clamping_main.jpg 850w, https:\/\/www.wheelsforwomen.ie\/wp\/wp-content\/uploads\/2019\/08\/clamping_main-300x175.jpg 300w, https:\/\/www.wheelsforwomen.ie\/wp\/wp-content\/uploads\/2019\/08\/clamping_main-768x448.jpg 768w\" sizes=\"(max-width: 850px) 100vw, 850px\" \/><\/figure>\r\n\r\n\r\n\r\n<p><strong><em>Can you appeal a clamping and is it worth making the effort asks Geraldine Herbert<\/em><\/strong><\/p>\r\n\r\n\r\n\r\n<p>Here&#8217;s what you need to know<\/p>\r\n\r\n\r\n\r\n<p><strong>Reasons for clamping<\/strong><\/p>\r\n\r\n\r\n\r\n<ol>\r\n<li>If your vehicle causes a hazard or obstruction, e.g. on a clearway<\/li>\r\n<li>If your vehicle is illegally parked, e.g. on a double yellow line.<\/li>\r\n<li>If the time allowed on a Pay-and-Display ticket (max. 3 hours) has expired.<\/li>\r\n<\/ol>\r\n\r\n\r\n\r\n<p>All signs in a car park have to be clearly readable, \u201cin plain language\u201d, clean and in good condition. They must also be properly positioned, of a certain size and must clearly state terms and conditions, including the clamp release charge and any additional charges.<\/p>\r\n\r\n\r\n\r\n<p><strong>Grounds for Appeal<\/strong><\/p>\r\n\r\n\r\n\r\n<p>1) Paid parking grace period &#8211; If you park your car where you have to pay for parking, you have a grace period of ten minutes to pay the parking fee before you are clamped. So, for example, if you have to run to a shop to get change to pay for the parking you have ten minutes to do so and put the parking ticket on the vehicle.<\/p>\r\n\r\n\r\n\r\n<p>2) You believe the clamping of your vehicle occurred\u00a0outside the time-period\u00a0of restricted parking.<\/p>\r\n\r\n\r\n\r\n<p>3) You believe the location where you parked was\u00a0not within a restricted parking zone.<\/p>\r\n\r\n\r\n\r\n<p>4) Your parking ticket was\u00a0not seen\u00a0by the clamping operator<\/p>\r\n\r\n\r\n\r\n<p><strong>How to appeal<\/strong><\/p>\r\n\r\n\r\n\r\n<p>1) If you are clamped in a statutory area (an area under the direction of a local authority) and want to make a complaint or appeal the clamping fee, you should contact your\u00a0local authority. You should write to or email the relevant authorities to make your complaint. You should give details of the situation and enclose any documents that could help your case. Most complaints will be acknowledged within a few days.
